I.

 

1. Ubytovací řád upravuje práva a povinnosti ubytovaných osob, tzn. osob, které sjednaly s ubytovatelem smlouvu o ubytování (dále také jen „hostů“ či „hosta“ či „ubytovaný“), a ubytovatele v apartmánech, rodinných domech, samostatných pokojích a v jiných ubytovacích prostorech (dále jen „Ubytovací prostory“), podmínky užívání a provozování Ubytovacích prostor, jakož i ostatní vzájemné právní vztahy.
   
   The Accommodation Rules regulate the rights and obligations of the accommodated persons, i.e. persons who have concluded an accommodation contract with the accommodation provider (hereinafter also referred to as "guests" or "guest" or "accommodated"), and the accommodation provider in apartments, family houses, separate rooms and other accommodation premises (hereinafter also referred to as "Accommodation Premises"), the conditions of use and operation of the Accommodation Premises, as well as other mutual legal relations.

 

1. Právo na ubytování v Ubytovacích prostorech vzniká na základě řádně uzavřeného smluvního vztahu o ubytování mezi ubytovatelem a ubytovaným. Smluvní vztah je uzavřen, dokončí-li ubytovaný rezervaci provedením úhrady ceny ubytování.
   
   The right to accommodation in the Accommodation Premises arises on the basis of a duly concluded contractual relationship between the accommodation provider and the Guest. The contractual relationship is concluded if the Guest completes the reservation by making payment of the accommodation price.

 

1. Tento ubytovací řád je smluvním ujednáním mezi hostem a ubytovatelem.
   
   These Accommodation Rules are a contractual arrangement between the Guest and the Accommodation Provider.

 

II.

Podmínky a způsob ubytování / Conditions and method of accommodation

 

1. Ubytovatel je oprávněn ubytovat jen hosta, který se prokáže platným občanským průkazem, cestovním pasem případně povolením k pracovnímu pobytu nebo jiným platným průkazem totožnosti (vyjma řidičského průkazu). Údaje z dokladu totožnosti budou zapsány do ubytovací knihy.
   
   The accommodation provider is only entitled to accommodate a guest who presents a valid identity card, passport or work permit or other valid identity document (except for a driving license). The details of the identity document will be entered in the accommodation book.

 

1. Podmínky zpracování osobních údajů hostů v souladu s GDPR se řídí interní směrnicí ubytovatele, která je k dispozici na internetových stránkách www.bestplaceinprague.com. Ubytovatel má zákonnou povinnost uchovávat o svých hostech některé osobní údaje, a to zejména jméno, příjmení, datum narození, adresa a doba ubytování, číslo a typ dokladu, případně vízum, účel pobytu. Tato povinnost se řídí zákonem o pobytu cizinců na území ČR (č. 326/1999 Sb.) a zákonem a místních poplatcích (č. 565/1990 Sb.). Dle těchto právních předpisů je ubytovatel povinen uchovávat osobní údaje o hostech po dobu 6 let. Osobní údaje nebudou použity k marketingovým účelům.
   
   The conditions for processing Guests' personal data in accordance with the GDPR are governed by the accommodation provider's internal directive, which is available on the website www.bestplaceinprague.com. The accommodation provider has a legal obligation to keep certain personal data about its Guests, in particular name, surname, date of birth, address and period of accommodation, number and type of document or visa, purpose of stay. This obligation is governed by the Act on the Residence of Foreigners in the Czech Republic (No. 326/1999 Coll.) and the Act on Local Fees (No. 565/1990 Coll.). According to this legislation, the accommodation provider is obliged to keep personal data on guests for 6 years. Personal data will not be used for marketing purposes.

 

1. Host je povinen se prokázat dokladem totožnosti. Pokud se host neprokáže platným průkazem totožnosti, je ubytovatel oprávněn ubytování hostovi odmítnout.
   
   The Guest is obliged to show proof of identity. If the Guest does not present a valid ID, the accommodation provider is entitled to refuse the Guest accommodation.

 

1. Na základě objednaného ubytování, není-li smluvně sjednáno jinak, je host v den příjezdu oprávněn se ubytovat v časovém rozmezí uvedeném v potvrzení rezervace. Pokud se host nedostaví k ubytování prvý den ubytování v časovém rozmezí uvedeném v potvrzení rezervace, je ubytovatel povinen zajistit hostovi přístup do ubytování až následující den v časovém rozmezí uvedeném v potvrzení rezervace. Host uhradí cenu za ubytování v plném sjednaném rozsahu.

On the basis of the booked accommodation, unless otherwise contractually agreed, the Guest is entitled to check in on the day of arrival within the time range specified in the booking confirmation. If the Guest does not arrive on the first day of the accommodation within the time range specified in the booking confirmation, the accommodation provider is obliged to provide the Guest with access to the accommodation on the following day within the time range specified in the booking confirmation. The Guest shall pay the full agreed price for the accommodation. 

 

 

1. Host vždy vyklidí a uvolní Ubytovací prostory nejpozději do 10.00 hod. sjednaného dne konce pobytu, pokud nebylo předem dohodnuto jinak.
   
   The Guest shall always vacate the Accommodation Premises by 10.00 a.m. on the agreed end of stay day at the latest, unless otherwise agreed in advance.

 

1. Ubytovatel si vyhrazuje právo neubytovat hosta, který je zjevně pod vlivem alkoholu nebo psychotropních a omamných látek. Cena ubytování se v takovém případě nevrací a host je povinen uhradit cenu za ubytování.
   
   The accommodation provider reserves the right not to accommodate a Guest who is obviously under the influence of alcohol or psychotropic and narcotic substances. The price of the accommodation is not refundable in such a case and the Guest is obliged to pay the price of the accommodation.

 

1. Ubytovatel je v případech hodných zřetele (havárie apod.) oprávněn nabídnout hostu jiný, náhradní Ubytovací prostor. V takovém případě má možnost ubytovaný tuto nabídku odmítnout a žádat vrácení uhrazené ceny ubytování, ledaže je nabídnutý Ubytovací prostor ve stejné lokalitě a v minimálně stejné kategorii ubytování a disponuje stejnou nebo vyšší ubytovací kapacitou. Případné rozdíly v ceně ubytování není ubytovaný povinen doplácet.
    

The accommodation provider is entitled to offer the Guest an alternative accommodation space in cases worthy of consideration (accident, etc.). In such a case, the Guest has the option to refuse this offer and request a refund of the accommodation price paid, unless the Accommodation Space offered is in the same location and in at least the same category of accommodation and has the same or higher accommodation capacity. Any differences in the price of accommodation shall not be reimbursed by the Guest.

 

III.

Práva a povinnosti ubytovatele a ubytovaného / Rights and obligations of the accommodation provider and the accommodated person

 

1. Ubytovatel odpovídá za škodu na vnesených věcech pouze v rozsahu ust. § 2946 a násl. zákona č. 89/2012 Sb., občanského zákoníku. Škoda se hradí nejvýše do 10ti násobku ceny ubytování za jeden den, ledaže se ubytovatel povinnosti nahradit škodu v souladu se zákonem zprostí. Ubytovatel proto doporučuje hostům, aby šperky, peníze, elektroniku a jiné cennosti neponechávali v Ubytovacích prostorech, a to zejména v době své nepřítomnosti.
   
   The landlord is liable for damage to the items brought in only within the scope of § 2946 et seq. of Act No. 89/2012 Coll., the Civil Code. Damage shall be covered up to a maximum of 10 times the price of accommodation per day, unless the accommodation provider waives the obligation to compensate for the damage in accordance with the law. The accommodation provider advises Guests not to leave jewellery, money, electronics and other valuables in the accommodation premises, especially during their absence.

 

1. Ubytovaný odpovídá za škodu způsobenou na zařízení a majetku ubytovatele v Ubytovacích prostorech, včetně prostor, které jsou společné pro hosty a případně jiné obyvatele domu, a to v plné výši, včetně náhrady ušlého zisku ve výši platné ceny za ubytování po celou dobu, po kterou nebude možné poskytnout příslušný Ubytovací prostor k ubytování jiným hostům. Hodnota inventáře Ubytovacích prostorů je stanovena v písemném záznamu, který je ubytovatel povinen ubytovanému na jeho žádost za účelem prokázání výše škody zpřístupnit.
    

The Guest shall be liable for any damage caused to the Accommodation Facilities and the property of the Accommodation Provider in the Accommodation Facilities, including areas shared by the Guests and other residents of the House, if applicable, in full, including compensation for lost profits in the amount of the applicable accommodation price for the entire period during which the Accommodation Facilities cannot be made available to other Guests. The value of the inventory of the Accommodation Premises shall be set out in a written record which the Host shall make available to the Guest upon request in order to prove the amount of the damage.

 

1. Ubytovaný není oprávněn umožnit ubytovat se v Ubytovacích prostorech osobám, které nejsou uvedeny v potvrzení o rezervaci. Pokud ubytovaný tuto povinnost poruší, uhradí ubytovateli smluvní pokutu ve výši 5.000,- Kč za každou neoprávněně ubytovanou osobu, a to mimo rámec náhrady škody.
   
   The Guest is not entitled to allow persons who are not listed in the booking confirmation to stay in the Accommodation Premises. If the Guest breaches this obligation, the Guest shall pay the Accommodation Provider a contractual penalty of CZK 5,000 for each person unlawfully accommodated, in addition to compensation for damages.

 

1. Ubytovaný odpovídá za veškerou škodu, kterou způsobí s ním ubytované osoby, ať už se jedná o osoby uvedené v potvrzení o rezervaci ubytování či nikoliv. Ubytovaný odpovídá za to, že ostatní s ním ubytované osoby budou dodržovat povinnosti sjednané ve smlouvě o ubytování a v tomto ubytovacím řádu.
    

The Guest is liable for all damages caused by persons staying with him/her, whether or not they are persons mentioned in the booking confirmation. The Guest is responsible for ensuring that the other guests staying with him/her comply with the obligations agreed in the accommodation contract and in these Accommodation Regulations.

 

1. Host je povinen nahradit způsobenou škodu na základě faktury vystavené do 14 dní ode dne skončení pobytu hosta, splatné do 10 dní od doručení této faktury do rukou hosta, pokud host škodu dobrovolně neuhradí do konce pobytu nebo pokud do konce pobytu není ubytovateli známa přesná výše způsobené škody.
   
   The Guest is obliged to compensate for the damage caused on the basis of an invoice issued within 14 days of the end of the Guest's stay, payable within 10 days of receipt of this invoice in the hands of the Guest, unless the Guest voluntarily pays the damage by the end of the stay or the exact amount of the damage caused is known to the accommodation provider by the end of the stay.

 

1. Host má právo požadovat odstranění vady vztahující se k funkčnosti a vybavení Ubytovacích prostor. Host je zároveň povinen hlásit zjištěné škody a závady ubytovateli bez zbytečného odkladu a kontaktovat příslušné složky integrovaného záchranného systému, je-li to nezbytné. Ubytovatel dbá na odstranění závad bez zbytečných průtahů, taktéž odpovídá za technický a hygienický stav Ubytovacích prostor.
   
   The Guest has the right to demand the removal of defects relating to the functionality and equipment of the Accommodation. The Guest is also obliged to report the detected damages and defects to the accommodation provider without undue delay and to contact the relevant units of the integrated rescue system, if necessary. The accommodation provider shall ensure that the defects are removed without undue delay and shall be responsible for the technical and hygienic condition of the accommodation premises.

 

1. Pokud host zanechá nebo zapomene v Ubytovacích prostorách po skončení ubytování svou movitou věc a požádá ubytovatele o zaslání věci, ubytovatel zašle movitou věc hostovi poté, kdy host uhradí předem náklady přepravy. Ubytovatel uchovává zanechané nebo zapomenuté movité věci jen po dobu 1 měsíce od posledního dne trvání ubytování. Poté si vyhrazuje právo tyto věci zničit.
   
   If the Guest leaves or forgets his/her movable property in the Accommodation Facilities after the end of the accommodation and asks the Accommodation Provider to send the property, the Accommodation Provider shall send the movable property to the Guest after the Guest has paid the transport costs in advance. The accommodation provider shall keep the left or forgotten movable items only for a period of 1 month from the last day of the accommodation. Thereafter, it reserves the right to destroy such items.

 

IV.

Všeobecná pravidla ubytování / General accommodation rules

 

1. V celé budově, v které se nachází Ubytovací prostory platí přísný zákaz kouření, užívání psychotropních a omamných látek a používání otevřeného ohně. V případě porušení tohoto zákazu má ubytovatel právo na úhradu smluvní pokuty ve výši 5.000,- Kč za každý jednotlivý případ porušení, a to mimo rámec náhrady škody. Host je povinen smluvní pokutu uhradit. Pokud host poruší povinnost podle tohoto odstavce opakovaně, je ubytovatel oprávněn odstoupit od smlouvy o ubytování a pobyt ukončit bez povinnosti vrátit poměrnou část ceny ubytování.
   
   Smoking, the use of psychotropic and narcotic substances and the use of open flames are strictly prohibited throughout the building in which the Accommodation is located. In the event of a violation of this prohibition, the accommodation provider is entitled to a contractual penalty of CZK 5,000 for each individual case of violation, in addition to compensation for damages. The Guest is obliged to pay the contractual penalty. If the Guest violates the obligation under this paragraph repeatedly, the accommodation provider is entitled to withdraw from the accommodation contract and terminate the stay without the obligation to refund a pro rata part of the accommodation price.

 

1. Host obdrží při nástupu k pobytu od ubytovatele klíč, kartu nebo čip od Ubytovacích prostor (a společných částí domu, kde se Ubytovací prostory nachází). Při ztrátě nebo zneužití klíče, karty nebo čipu je ubytovaný povinen uhradit smluvní pokutu ve výši 1.000,- Kč za každý případ ztráty nebo zneužití klíče nebo čipu, a to mimo rámec náhrady škody.
   
   The Guest shall receive a key, card or chip to the Accommodation Premises (and the common parts of the house where the Accommodation Premises are located) from the Host upon check-in. In the event of loss or misuse of the key, card or chip, the Guest is obliged to pay a contractual penalty of CZK 1,000 for each case of loss or misuse of the key or chip, in addition to compensation for damages.

 

1. Host užívá Ubytovací prostory na dobu, kterou sjednal s ubytovatelem.
   
   The Guest shall use the Accommodation Premises for the period agreed with the Host.

 

1. Přijímání návštěv hostem v Ubytovacích prostorách není možné, pokud se host s ubytovatelem nedohodli jinak. Host odpovídá za veškerou škodu, která ubytovateli vznikne v důsledku porušení tohoto zákazu.
   
   Receiving visitors by the Guest in the Accommodation Premises is not possible unless the Guest and the Host have agreed otherwise. The Guest shall be liable for any damage incurred by the Host as a result of a breach of this prohibition.

 

1. Host není oprávněn uspořádat v Ubytovacích prostorech oslavy nebo jiné společenské akce; to platí i v případě, že se jich účastní pouze osoby uvedené v potvrzení o rezervaci. V případě porušení tohoto zákazu má ubytovatel právo na úhradu smluvní pokuty ve výši 5.000,- Kč za každý jednotlivý případ porušení, a to mimo rámec náhrady škody. Pokud host poruší povinnost podle tohoto odstavce opakovaně, je ubytovatel oprávněn odstoupit od smlouvy o ubytování a pobyt ukončit bez povinnosti vrátit poměrnou část ceny ubytování. Nárok na smluvní pokutu podle odstavce 12. tohoto článku tím není dotčen.
   
   The Guest is not entitled to organise parties or other social events in the Accommodation; this applies even if only the persons specified in the booking confirmation attend. In case of violation of this prohibition, the accommodation provider is entitled to a contractual penalty of CZK 5,000 for each individual case of violation, in addition to compensation for damages. If the guest violates the obligation under this paragraph repeatedly, the accommodation provider is entitled to withdraw from the accommodation contract and terminate the stay without the obligation to refund a pro rata part of the accommodation price. The right to a contractual penalty pursuant to paragraph 12 of this Article shall not be affected.

 

1. Hostovi není dovoleno bez souhlasu ubytovatele přemisťovat zařízení a nábytek z důvodu možného poškození povrchu podlahové krytiny a zařízení a provádět zásahy do elektrické sítě, jiné instalace nebo elektrických spotřebičů.
   
   The Guest is not allowed to move equipment and furniture without the accommodation provider's consent due to possible damage to the floor covering and equipment and to tamper with the electrical network, other installations or electrical appliances. 

 

1. V Ubytovacích prostorech není hostům dovoleno používat vlastní elektrické spotřebiče (zejména rychlovarné konvice, přenosné vařiče nebo mikrovlnné trouby). Toto nařízení se netýká drobné domácí elektroniky (notebook, mobilní telefon apod.) a elektrických spotřebičů osobní hygieny (holící strojek, zubní kartáček atd.).
   
   Guests are not allowed to use their own electrical appliances (especially kettles, portable cookers or microwaves) in the Accommodation. This regulation does not apply to small household electronics (laptop, mobile phone, etc.) and electrical personal hygiene appliances (shaver, toothbrush, etc.).

 

1. Hostům není dovoleno vnášet do Ubytovacích prostor kola, dětské kočárky, dětské vozíky, neujednají-li si ubytovatel a ubytovaný jinak. K uložení těchto věcí slouží kolárna či kóje, pokud jsou k dispozici.
   
   Guests are not allowed to bring bicycles, strollers, baby carriages into the Accommodation unless otherwise agreed between the Host and the Guest. The bicycle room or cubicle, if available, is used to store these items. 

 

1. Hosté nejsou oprávněni chovat v Ubytovacích prostorech psy a jiná domácí zvířata, není-li dohodnuto jinak.

Guests are not allowed to keep dogs and other pets in the Accommodation Premises unless otherwise agreed.

 

1. Host nesmí v Ubytovacích prostorách nosit zbraň ani střelivo.
   
   Guests may not carry weapons or ammunition in the Accommodation.

 

1. Základní úklidové prostředky jsou součástí vybavení Ubytovacích prostor. Během pobytu se úklid v Ubytovacích prostorách neprovádí, není-li dohodnuto jinak.
   
    

Basic cleaning products are included in the equipment of the Accommodation. There is no cleaning in the Accommodation during the stay unless otherwise agreed.

 

1. V době od 22.00 hodin do 6.00 hodin je v Ubytovacích prostorech (a ve společných částech domu, kde se tyto prostory nachází) režim nočního klidu, kdy je host povinen chovat se tak, aby nerušil ostatní nadměrným hlukem. Host je povinen uhradit ubytovateli smluvní pokutu ve výši 5.000,- Kč za každou noc, kdy dojde k rušení nočního klidu, a to mimo rámec náhrady škody.
   
   From 22.00 to 06.00, the Accommodation premises (and the common parts of the house where these premises are located) are subject to a night-time quiet regime, when the Guest is obliged to behave in such a way as not to disturb others with excessive noise. The Guest is obliged to pay a contractual penalty of CZK 5,000 for each night of disturbance of the night peace, in addition to compensation for damages.

 

1. Před každým odchodem z Ubytovacích prostor (včetně odchodu při ukončení pobytu) je host povinen uzavřít vodovodní kohoutky, zhasnout světla, vypnout televizi a klimatizaci, rychlovarnou konvici, sporák, troubu a jiné elektrické spotřebiče (vyjma ledničky a jiných zařízení, které musí být v nepřetržitém provozu) a zavřít okna a zamknout vchodové dveře.
   
   Before leaving the Accommodation premises (including leaving at the end of the stay), the Guest is obliged to turn off the water taps, turn off the lights, turn off the TV and air conditioning, kettle, stove, oven and other electrical appliances (except for the refrigerator and other devices that must be in continuous operation) and close the windows and lock the front door.

 

1. Host je povinen v Ubytovacích prostorách, jakož i v domě a okolí zachovávat obvyklý pořádek a před opuštěním ubytovacího prostoru uvést prostory do stavu, který odpovídá stavu obvyklého použití. Pro případ znečištění ubytovacích prostor nad rámec obvyklého užívání je ubytovatel oprávněn účtovat poplatek za nadměrný úklid ve výši 1.000,- Kč a host je povinen tento poplatek uhradit.
   
   The Guest is obliged to keep the Accommodation Premises, as well as the house and its surroundings in good order and to restore the premises to a state of normal use before leaving the Accommodation Premises. In the event of soiling of the Accommodation Premises beyond normal use, the Host is entitled to charge an excessive cleaning fee of CZK 1,000 and the Guest is obliged to pay this fee.

 

1. Host je povinen se s tímto ubytovacím řádem seznámit a dodržovat ustanovení tohoto ubytovací řádu. V případě, že host nebude dodržovat ubytovací řád, má ubytovatel právo odstoupit od smlouvy o ubytování před uplynutím dohodnuté délky pobytu bez náhrady. Právo na úhradu smluvní pokuty nebo náhrady škody není takovým odstoupením dotčeno.
   
   The Guest is obliged to familiarize himself with these accommodation regulations and to comply with the provisions of these accommodation regulations. In the event that the Guest fails to comply with the accommodation rules, the accommodation provider has the right to withdraw from the accommodation contract before the expiry of the agreed length of stay without compensation. The right to payment of a contractual penalty or damages is not affected by such withdrawal.
